OVERVIEW

Welcome to Pleinair Tools Shop! The terms “we”, “us” and “our” refer to Pleinair Tools. Pleinair Tools operates this online store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Pleinair Tools Shop is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own or manage.

To use the Services, including browsing or purchasing products, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all such information is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and all account activity. You may not transfer or sell your account to any other person.

SECTION 2 – OUR PRODUCTS

We have made every effort to display accurate product images and descriptions. Please note that product colors and appearances may differ slightly due to screen settings or production methods.

Some of our products are manufactured using modern techniques such as 3D printing, which may result in small natural variations in surface texture, finish, or strength. These do not constitute defects.

We reserve the right to discontinue any product at any time and may limit quantities offered.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. An order is only accepted once we confirm it and payment is successfully processed.

Orders cannot always be changed or cancelled once accepted. If we decline or cancel an order, you will be notified.

Purchases are for personal use only and not for resale or export. Returns and refunds are handled according to our Refund & Return Policy and the EU Right of Withdrawal (see Section 5).

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and confirmed in your order email.

Unless otherwise stated, prices include applicable VAT for EU customers but exclude shipping, customs duties, or import taxes, which may apply depending on your location.

You agree to provide complete and accurate billing and payment information. You confirm that the payment method used belongs to you and that you are authorized to use it.

SECTION 5 – SHIPPING, DELIVERY & RIGHT OF WITHDRAWAL

Shipping & Delivery

  • Estimated delivery times for products in stock:

    • Germany: 3–7 Days

    • EU: 7–14 Days

    • Outside EU: varies by carrier and customs

  • Delivery times are not guaranteed. We are not liable for delays caused by carriers, customs, or circumstances outside our control. Once goods are handed to the carrier, risk of loss passes to you.

  • For non-EU orders, customs duties, taxes, or import fees are your responsibility.

EU Right of Withdrawal (Widerrufsrecht)

If you are a consumer residing in the EU, you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you, or a third party designated by you (other than the carrier), receive the goods.

To exercise this right, you must notify us clearly (e.g., by email) at: info@pleinairtools.com

You may use the EU model withdrawal form (provided at the end of these Terms), but it is not mandatory.

Effects of Withdrawal:

  • If you withdraw, we will refund all payments received from you (including standard delivery costs) within 14 days of receiving your notice, using the same payment method as your order.

  • You must return the goods to us without undue delay and at the latest within 14 days from notifying us.

  • You bear the direct cost of returning goods.

  • You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

Exemptions: The right of withdrawal does not apply to custom-made goods or goods clearly tailored to personal requirements.

SECTION 6 – INTELLECTUAL PROPERTY

All trademarks, names, product designs, text, images, graphics, and content in our Services are owned by Pleinair Tools or licensors. They may not be copied, reproduced, or used without prior written consent.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools or features, which are provided “as is” without warranties. Use of such tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or policies of those websites. Please review their terms before engaging.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Pleinair Tools Shop is powered by Shopify. However, all sales and transactions are made directly with Pleinair Tools. Shopify is not responsible for your purchases or any related claims.

SECTION 10 – PRIVACY POLICY

All personal data is handled according to our Privacy Policy [LINK] and Shopify’s Privacy Policy. By using our Services, you consent to this processing.

SECTION 11 – FEEDBACK

If you provide reviews, suggestions, or feedback, you grant us a royalty-free license to use them for commercial purposes.

We reserve the right to correct errors or inaccuracies in product descriptions, pricing, or availability, even after an order has been placed.

You agree to indemnify and hold harmless Pleinair Tools and its partners against claims arising from your misuse of the Services or breach of these Terms.

SECTION 18 – SEVERABILITY

If any provision is found unenforceable, the rest remain valid.

Failure to enforce any provision does not waive it. These Terms and referenced policies constitute the entire agreement.

You may not assign rights or obligations without our consent. We may assign ours without notice.

These Terms are governed by the laws of Germany. If you are a consumer in the EU, mandatory provisions of your country of residence may also apply. Disputes shall be subject to the courts of Munich, Germany, unless mandatory consumer law provides otherwise.

Headings are for convenience only and have no legal effect.

SECTION 23 – CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services after changes means acceptance.
